Terms of Service

These Terms govern access to and use of TapReview. By creating an account or using the service, you agree to them.

1. Acceptance of Terms

By accessing or using TapReview, you agree to these Terms and our Privacy Policy. If you use TapReview for a business or organization, you represent that you have authority to bind it. If you do not agree, do not use the service.

2. TapReview Service

TapReview provides review-request software, tracked QR and NFC links, customer feedback experiences, private-feedback collection, business analytics, SMS review requests, subscription features, and hardware or device-related functionality. Features may vary by plan and configuration. TapReview provides tools and observed interaction metrics, not guaranteed customer responses, review results, revenue, or business outcomes.

3. Business Responsibilities

Businesses are responsible for maintaining accurate account, business, location, team, contact, review-destination, and billing information; securing their accounts; using TapReview lawfully; obtaining all required customer permissions and consents; honoring customer choices; configuring authorized personnel; complying with carrier, Twilio, Google, and other applicable platform policies; and ensuring submitted content and data are lawful and appropriate.

Businesses must not upload or submit unlawful, infringing, deceptive, harmful, or unauthorized information. A business remains responsible for its customer relationships, services, communications, and responses to private feedback.

4. SMS Terms

Customers may receive review-request or service-follow-up SMS messages after providing consent to a participating business. Message frequency varies and customers generally receive no more than one review-request message per service interaction. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to receive SMS is not a condition of receiving the participating business’s underlying service.

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may depend on carrier availability, device compatibility, network conditions, consent status, and third-party services.

5. Prohibited SMS Use

Businesses and users may not use TapReview to send unsolicited messages; contact purchased, rented, scraped, or otherwise unauthorized lists; bypass or disregard opt-outs; send unlawful spam; misrepresent sender identity; harass recipients; conceal the purpose of a message; or evade carrier, Twilio, registration, consent, or messaging requirements. TapReview may suspend messaging access to protect recipients, the service, or provider relationships.

6. Review-Platform Responsibilities

Businesses remain responsible for compliance with Google’s and other review platforms’ rules, including restrictions concerning incentives, misrepresentation, manipulation, and prohibited content. TapReview does not guarantee review publication, star ratings, rankings, review volume, removal decisions, or any action by a third-party platform.

7. Google Review Clicks

A TapReview “Google Review Click,” “Google page open,” or redirect means TapReview observed a user opening or clicking the configured Google destination. It does not confirm that the user submitted a review or that Google accepted or published one. Businesses must not present click metrics as confirmed posted reviews.

8. Subscriptions and Billing

Paid software features are billed according to the plan and price presented at checkout. Stripe processes payments and remains authoritative for payment and subscription status. Recurring subscriptions continue according to the checkout terms until canceled through an available billing method. Plan changes, cancellation timing, refunds, taxes, invoices, and access after cancellation are governed by the applicable checkout terms, billing interface, and law. Nothing in these Terms creates a refund promise beyond what TapReview expressly presents or applicable law requires.

9. Hardware

TapReview may offer NFC cards, QR materials, stands, or other hardware separately from software subscriptions. Product features, customization, price, shipping charges, and availability are those presented when an order is placed. Delivery timing may vary, and TapReview does not promise a shipping date unless expressly confirmed for a particular order. Customers must provide accurate customization and shipping information and test delivered devices before relying on them in production.

10. Accounts and Security

Users must provide accurate account information, keep credentials confidential, use appropriate access roles, and promptly notify TapReview of suspected compromise. Users are responsible for activity under their accounts except to the extent caused by TapReview’s breach of these Terms or applicable law. We may require verification, restrict access, or reset credentials to protect the service.

11. Intellectual Property

TapReview and its software, branding, designs, documentation, and service content are owned by TapReview or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, TapReview grants customers a limited, non-exclusive, non-transferable right to use the service for their internal business purposes during an active entitlement. Customers retain rights in their business content and grant TapReview the limited rights needed to host, process, display, and transmit that content to provide the service.

12. Termination and Suspension

You may stop using TapReview and may manage an eligible subscription through the available billing tools. TapReview may suspend or terminate access for material breach, unlawful or abusive activity, payment failure, security risk, harm to recipients, provider-policy violations, or where continued service would create legal or operational risk. Where reasonable, we will attempt to provide notice or an opportunity to cure, but urgent protective action may be immediate.

13. Disclaimers

To the maximum extent permitted by law, TapReview is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not control carriers, Google, Stripe, Supabase, Twilio, Resend, Vercel, customer devices, or other third-party services and are not responsible for their independent acts, outages, rules, or decisions.

14. Limitation of Liability

To the maximum extent permitted by law, TapReview and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, reviews, or business opportunities arising from the service. To the maximum extent permitted by law, aggregate liability relating to TapReview will not exceed the amount paid to TapReview for the service during the twelve months before the event giving rise to the claim. These limitations do not apply where prohibited by law.

15. Indemnification

To the extent permitted by law, a business agrees to defend, indemnify, and hold harmless TapReview and its operators from third-party claims, liabilities, damages, and reasonable costs arising from the business’s customer communications, failure to obtain consent, submitted content, misuse of the service, violation of law or platform policy, or breach of these Terms.

16. Changes to Terms

We may update these Terms as TapReview, provider requirements, or applicable laws change. The Last Updated date identifies the current version. Continued use after updated Terms take effect constitutes acceptance where permitted by law. If a material change requires additional notice or consent, we will use an appropriate method.
